The Terms of Service:


The use of services from smpbusinesshosting.co.uk [Hereafter referred as "Smp Business Hosting" or "we"] constitutes agreement to these terms, our privacy and mail policy.All documents can be seen here.

The terms 'reasonable', 'reason' and 'reasoning' is at Smp Business Hosting's sole discretion as to what falls under this category.

1. Account Setup/ Email on file
 
A)
We will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s) incase of fraud. It is your responsibility to provide us with an email address which is not @ the domain(s) you are signing up under.		  

B)
We will make every effort to help you move your site to us, however, we can not make guarantees of the transfer process. We provide this as a courtesy service and can not make guarantees regarding its availability or the amount of time it may take as each host is configured a little differently. We will try our best, however, in some cases we may be unable to assist you in a transfer of data from an old host.

Acceptable Use
 
Content
All site, files and uploaded content must be in appliance with United Kingdom and your local applicable law. We do not allow the following to be stored on, preformed on, linked to or in connection with our servers:		  

A)
Use of our services to infringe upon any copyright or trademark is prohibited. This includes but is not limited to unauthorized copying of music, books, photographs, or any other copyrighted work. The offer of sale of any counterfeit merchandise of a trademark holder will result in the immediate termination of your account. If you believe that your copyright or trademark is being infringed upon, please email abuse@smpbusinesshosting.co.uk with the information required. A list of required information may be found If the request is of a licensing issue, we may require further documentation.

B)
Hate sites promoting any form of racism or prejudice, segregation and extremist opinions.

C)
Pornography Sites - all forms of pornography sites are strictly prohibited. This does not include merchandise or images used as illustrations or examples in connection with merchandise (e.g. magazine covers, catalogue images etcetera).

D)
Viruses or hacker focused sites this includes the content of forum or similar posts; it is your responsibility to maintain the content published by users of your website.

E)
Promotion of illegal activities this includes but is not limited to: home made bomb, vandalism, criminal activities and drug how to focus sites. This does not prevent you from using or mentioning these items when used in an applicable manner.

F)
Any Website with material unsuitable for minors must stipulate so on the index/ home page before presented before the user.

G)
Other unacceptable material: IRC Bots, Proxy scripts/ Anonymizers, free hosting sites such as email, images and websites, Escrow, High-Yield Interest Programmes (HYIP) or related sites, Investment sites
(e.g. Forex, egold exchange), Bank Debentures, Bank Debenture Trading Programmes, Prime Bank Programmes, lottery sites, AutoSurf sites, Charities unless you have been pre-approved by providing us with proof of charity registration (we only host United Kingdom charities).
3.
Server Resource Usage
 
A)
Users may not:
a) Use 25% or more of the system resources for longer than 90 seconds. There are numerous problems that could cause this such as: CGI scripts, FTP, PHP, HTTP, ect.
b) Run stand-alone, unattended server-side processes at any point in time on our server.
This includes any and all daemons, such as IRCD.
c) Run any software that interfaces with an IRC (internet relay chat) network.
d) Run any bit torrent application, tracker, or client. Please note you make link to legal torrents, but may not store or host them.
e) Participate in any file-sharing/ peer-to-peer activities.
f) Run any gaming servers such as counter-strike, half life, battlefield1942, ect.
g) Run cron entries with intervals of less than 15 minutes.		  

B)
You will only be able to use the allocated amount of space and bandwidth that comes with the package you select. If you start to run low on resources due to a high volume of visitors and/or sent e-mails it is your responsibility to upgrade to a package with more resource space to avoid temporary downtime of your site.

C)
If using PHP includes functions for including a local file, include the local file by the path and not the URL. Instead of:
include('http://www.yoursite.com/includes/file.php'); use:
include('inludes/file.php'); or:
include('home/user/public_html/inludes/file.php');
By writing it in the later format of the two you will be using less server resources.

D)
If the script you are using is using a high volume of the server's resources for a continuous period we will either disable part of the script or suspend your account to avoid further problems on the server, and notify you detailing the problem and help you find a solution to resolve the situation.
4.
Refunds
 
A)
The refund only applies to 'Business Hosting' and 'Email' hosting plans.		  

B)
You may only apply for a refund once; it must be applied for within fifteen days from the order date and the request must be received before midnight (GMT) of the fifteenth day, regardless of the time of purchase.

C)
Only the fist/ initial account you sign up with will be applicable to receive the refund later accounts cannot (the aim of the refund is so that you may test our services once).

D)
You will only be refunded the whole price of the hosting package this does not include: domain names, service charges e.g. design, software, installation services, SSL certificates and anything other that the unit price of the hosting package as stated on the invoice.

E)
We have the right to refuse a refund to any individual that has violated our 'TOS'.
5.
Dispute Resolution
 
A)
By using any services provided by Smp Business Hosting and its subsidiaries in relation to Smp Business Hosting you agree to binding arbitration. If any disputes or claims arise against Smp Business Hosting and/or its subsidiaries, such disputes will be handled by an arbitrator chosen by the Chartered Institute of Arbitrators. All decisions made by that arbitrator are binding and final. You are also responsible for any and all fee's incurred by such arbitration, arbitration will be handled online.		  
5.
Disclosure to law enforcement
 
A)
Smp Business Hosting will co-operate with all law enforcement agencies with or without your acknowledgement.		  

B)
Smp Business Hosting may disclose your personal information to any law enforcement agency given good 'reasoning' with or without prior notice or your involvement.

Disclaimer
   
A)
Smp Business Hosting is not responsible for any damages, losses or problems to your business or website that may be associated from using our services or products.		  

B)
Smp Business Hosting makes no warranties of any kind, expressed or implied for services we provide. Smp Business Hosting disclaims any and all warrantee, merchantability or fitness for any purpose. This includes but is not limited to loss of data resulting from: delays, no deliveries, wrong deliveries and any service interruptions caused by Smp Business Hosting and its employee's.
5.
Changes to, and enforcement of, the Legal Documents
 
A)
Smp Business Hosting reserves the right to make amendments to any of the Legal Documents This may be done at anytime with or without notice; such changes will be announced within your client area.		  

B)
If any part of the TOS is deemed unenforceable it will not affect any other sections within the TOS and will remain enforceable.
